These Terms apply to all visitors, clients, and others who access or use our website located at whitmorepublishinghouse.com and all associated services.
2. Description of Services
Whitmore Publishing House provides book marketing, publishing, editing, writing, illustration, audiobook production, and related author services. The scope of services for each client is defined in individual project agreements or statements of work.
We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.
3. Account Responsibilities
If you create an account or engage our services, you are responsible for:
- Providing accurate, current, and complete information.
- Maintaining the confidentiality of any account credentials.
- All activities that occur under your account.
- Notifying us immediately of any unauthorized use of your account.
4. Payment & Fees
All fees for services are outlined in your individual project agreement. By engaging our services, you agree to pay all applicable fees on the schedule specified. Failure to make timely payments may result in suspension of services.
All prices are quoted in USD unless otherwise stated. We accept major credit cards, PayPal, and bank transfers. Tax obligations are the responsibility of the client where applicable.
5. Intellectual Property
You retain full ownership and copyright of your original manuscript, story concepts, and creative work. Upon full payment, all deliverables produced by Whitmore Publishing House for your project are transferred to you.
Whitmore Publishing House retains the right to display completed work in its portfolio unless you request otherwise in writing prior to project completion.
6. Prohibited Conduct
You agree not to:
- Use our services for any unlawful purpose or in violation of any regulations.
- Submit content that is defamatory, obscene, or infringes any third-party rights.
- Attempt to gain unauthorized access to our systems or networks.
- Resell or redistribute our proprietary tools, templates, or methodologies without written consent.
- Engage in fraudulent activity, including providing false information.
7. Disclaimer of Warranties
Our services are provided on an "as is" and "as available" basis. While we strive to deliver professional, high-quality work, we make no warranties or representations — express or implied — regarding specific commercial outcomes such as sales figures, bestseller rankings, or media placements.
8. Limitation of Liability
To the fullest extent permitted by law, Whitmore Publishing House shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total cumulative liability shall not exceed the total fees paid by you for the specific service giving rise to the claim.
9. Termination
Either party may terminate a project engagement with written notice according to the terms specified in your individual service agreement. Early termination fees may apply as outlined in your project contract. Upon termination, provisions relating to intellectual property, payment obligations, and limitation of liability survive.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the courts located in New York County, New York.
